SUBSTITUTE TRUSTEE'S NOTICE OF SALE

 

Sale at public auction will be on March 3, 2025, at or about 3:30 PM, local time, at the front door of the Lake County Courthouse, 229 Church Street, Tiptonville, TN 38079, pursuant to the Deed of Trust executed by MARTHA A BREEDEN, to ARNOLD M WEISS, as Trustee for MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS NOMINEE FOR COUNTRYWIDE HOME LOANS, INC. dated April 2, 2002, and recorded in Book 180, Page 392, in the Register's Office for Lake County, Tennessee (“Deed of Trust”), conducted by Padgett Law Group, having been appointed Substitute Trustee, all of record in the Lake County Register's Office. Default in the performance of the covenants, terms, and conditions of said Deed of Trust has been made; and the entire indebtedness has been declared due and payable.

The hereinafter described real property located in Lake County will be sold to the highest call bidder subject to all unpaid taxes, prior liens, and encumbrances of record:

Legal Description: Lying and being situated in the Fifth (5th) Civil District of Lake County, Tennessee, and within the corporate limits of Ridgely, Tennessee, and being more particularly described as follows: Beginning at an iron rod at the intersection on the north right-of-way of Tatum Street with the east right-of-way of College Street, the southwest corner of this herein described parcel; runs thence north 05 degrees 15 minutes west 105.00 feet along the east right-of way of College Street and the west line of this parcel to an iron rod, the southwest corner of Herman Lowell MacLin property as shown by deed in Deed Book EE, page 599, recorded in the Register`s Office for Lake County, Tennessee, and being the northwest corner of this herein described parcel; runs thence north 85 degrees 29 minutes east 150.00 feet along a fence line, the south line of said MacLin property and the north line of this parcel to a metal fence post in the west line of Otha Nelson Patterson property as shown by deed in Deed Book II, page 227, recorded in the Register`s Office for Lake County, Tennessee, the southeast corner of said MacLin Property and being the northeast corner of this herein described parcel; runs thence south 05 degrees 15 minutes east 105.00 feet along a fence line, the west line of said Patterson property and the east line of this parcel to an iron rod on the north right-of-way of Tatum Street, the southwest corner of said Patterson property and being the southeast corner of this herein described parcel; runs thence south 85 degrees 29 minutes west 150.00 feet along the north right-of-way of Tatum Street and the south line of this parcel to the Point of Beginning, and contains 0.36 acres, more or less. This property is shown by plat of survey dated April 4, 1990, made in the name of O.V. Fowler, Jr., et ux, by Mickey L. McClure, surveyor, with Tennessee License No. 1376.

This being the same property conveyed unto David B. Callens and wife, Sharon P. Callens by warranty deed dated September 12, 1996, and recorded September 16, 1996 in Deed Book U-1, pages 86-7, in the Register`s Office for Lake County, Tennessee.

 

Being the same property conveyed unto Martha A. Breeden by warranty deed dated 04-02-02, recorded in Deed Book E-2, pages 98-99, in the Register`s Office for Lake County, TN.

 

The last deed of record is a Quitclaim Deed recorded 08/24/2006 in Record Book 14, Page 764 in the Register’s Office for Lake County, TN.

 

Street Address: The street address of the property is believed to be 448 North College Street, Ridgely, TN 38080, but such address is not part of the legal description of the property. In the event of any discrepancy, the legal description herein shall control.

This sale is subject to all matters shown on any applicable recorded Plat or Plan; any unpaid taxes and assessments; any restrictive covenants, easements or setback lines that may be applicable; rights of redemption, equity, statutory or otherwise, not otherwise waived in the Deed of Trust, including rights of redemption of any government agency, state or federal; and any and all prior deeds of trust, liens, dues, assessments, encumbrances, defects, adverse claims and other matters that may take priority over the Deed of Trust upon which this foreclosure sale is conducted or are not extinguished by this Foreclosure Sale.

THE PROPERTY IS SOLD WITHOUT ANY REPRESENTATIONS OR WARRANTIES, EXPRESSED OR IMPLIED, RELATING TO TITLE, MARKETABILITY OF TITLE, POSSESSION, QUIET ENJOYMENT OR THE LIKE AND FITNESS FOR A GENERAL OR PARTICULAR USE OR PURPOSE. The title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.

The right is reserved to adjourn the sale to another time certain or to another day, time, and place certain, without further publication upon announcement on the day, time, and place of sale set forth above or any subsequent adjourned day, time, and place of sale.

If you purchase a property at the foreclosure sale, the entire purchase price is due and payable at the conclusion of the auction in the form of a certified check made payable to or endorsed to Padgett Law Group.  No personal checks will be accepted. To this end, you must bring sufficient funds to outbid the lender and any other bidders.  Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded to the successful purchaser at the time the foreclosure deed is delivered.

This property is being sold with the express reservation that the sale is subject to confirmation by the lender or trustee.  This sale may be rescinded by the Substitute Trustee at any time.
